Legal Question in Workers Comp in Pennsylvania

Attorney

Our WC Attorney says he is no longer representing my wife in her WC case. He does have an acquaintence arguing the case for him. The case is in appeal because she lost. We demanded he do something for us on July 31. He sent an e-mail saying he no longer represented my wife. The same day he emailed the opponents attorney for the name of who we demanded he get for us. August 23 he informed of the 3rd party name. We had no idea he did this, he told us he no longer represnted my wife in either case, and supposedly the statute ran out for third party on 21 August. The question is, can he just email us and say he is no longer represnting us in the WC case, and after saying he quit us, can he get the name of the third party. Something smells foul to us here. He had one year to get this name and he cost my wife the option to go after the real responsible party.

Re: Attorney

Clearly, the manner in which your attorney terminated his representation was not proper. Further, you may very well have been prejudiced with respect to any third party action. I would have to know more of the facts of the case, before giving a definite opinion. Please feel free to contact me, either by e-mail at [email protected], or by phone at 610-644-8300 or at 570-633-7300.
