Legal Question in Workers Comp in Pennsylvania

Employer's Doctor hardly checked my Injury

I injured My back at work Jan16. went to Chiropractor the 19th .On the 21'st My Work called and said I can't go to my doctor, and they have to file a claim. Work sent Me to local Emergency room ( who they use for injuries). The Doctor came in and touched my back and said You just have a muscle spasam. He was going to send Me home with a Perscription. I said I need xrays and they did them . Doctor came back and said as I said a Muscle spasm. Here is a Perscription , go back to work thursday the 24th. My Back is still all messed up!!! What do I do?

Under the worker's comp. law you are obligated to see "the company doctor" for the 1st 90 days of disability. However , this only applies if your employer has posted in a prominent location (a place where employees would normally be able to see it) a list of at least 6 medical facilities where employees should go if hurt at work. This is not a list that the manager pulls out of a drawer when an employee is hurt- it must be prominently posted. If the employer has done that, you are obligated to seek treatment by one of those medical facilities. The employer cannot send you to a specific one. If you claim that no posted list exists, try to get support from a co-employee to back-up your claim, if needed. You should consult with an experienced worker's comp. lawyer to discuss in detail the best strategy at this point to obtain proper medical care & to protext your interests. Good luck!!
