Legal Question in Workers Comp in Pennsylvania
knee injury question
i'm a 48 year old female who has a urgent question i was doing very heavy lifting on jan. 2006 when my back went out in severe pain and i dropped a 40 pound box on my right knee and when i went to the er the doctor did mris and x-rays and told me i have severe chondramalacia pattellia and arthritis of my knee well i never had any problems with this knee in my life could this dropping of the heavy box or the heavy lifting cause this underlying condition to surface? just your opinion please. what do you suggest i do. also at the time the workmans comp filed only for my back not my knee now they're trying not to pay for my knee they paid for my knee treatments up till they found out i need total knee replacement then they quit paying i had everything possible alreadty done to the knee replacement is the only thing left. i was treated for my back for two weeks after the injury then they started treating me for my knee also. is this too late to get my knee added to the workmans comp injury? it was checked one week after my back. what do you suggest i do now. i'm in great need of help. workman's comp did pay for the knee for several months then quit.

Re: knee injury question
You need to hire an experienced workers' compensation attorney from your area. When you are injured at work and your employer accepts the injury by paying the medicals, in order to stop paying the insurance company has to file a termination or modification petition. It sounds to me like your employer's insurance carrier may be on the hook for the knee replacement already but you really need an attorney local to your area to review the medical records and compensation documents to know for sure.
Re: knee injury question
1. The prior advice about contacting an attorney experienced in WC cases is good advice
2. The proper petition is probably a review petition.
3. Contact me if you need help locating a WC atty in your area
Re: knee injury question
you need to fiel a claim for benefits thru the comp court system. If you can prove that you were injured at work, you should be paid. You will need an attny because your case is not the norm. WHere do you live in PA?
