Legal Question in Workers Comp in Pennsylvania

Offered settlement Want us to name price

My Husband was injured on the job several years back. Broken hip required 2 surguries so far and more to come. He walks with a limp and has pain. The WC wants to settle in a lump sum, and asked us name a price. How do we correctly determine amount and all unforseen future medical problems and surgeries? We have 4 kids and I only can work part time due to the kids. My husbands Doctor said he will most likely need a new hip replacement every 10 years. My husband is only 48.Any suggestions?

You need either an attorney trained to do the calculations or an economist to determine the proper amount you need. There is 17-19 years of work expentancy left. Actuarial tables will tell you how much to set aside for medical expenses. I offer free consultations.

As a former Dept of Labor and Industry lawyer within the Bureau of Workers' Comp, I must tell you that an award or settlement exceeding $100,000.oo is still something of a rarity.

multiple factors must be examinedin order to justify the highest plausible demand. it sounds as if the carrier wants a compromise and release rather than a commutation, so obtaining the average cost of a hip replacement surgery should be an additional element of your demand.

hire counsel immediately. I always recommend Charles Martin of martin, pond lehockey et al for the eastern part of the state which your zip code suggests. in reality, any lawyer should want to represent you. choose specialized claimants' counsel rather than a generalist.
