Legal Question in Workers Comp in Pennsylvania
OOPS help
I fell at work going up steps which were damaged and not up to code. I have two herniated discs and in severe pain. This happened over one year ago. Getting ready for surgery now since nothing has helped. The steps have been replaced so no more injuries occur. Can I get a settlement and sue for negliengence? What would be a right settlement? My life has changed drastically. I even missed my sons graduation because I can not sit long. I already have workmens comp and doctor says surgery may not work. HELP PLEASE!!!!

Generally speaking, workers compensation is your only remedy when you are injured at work. Whether or not you have a right to sue the owner of the premises where you were injured is very dependent upon the facts. You may want to consider a Compromise and Release with your employer's insurance carrier which would provide you with a lump sum but I suggest that it may be better to wait until after the surgery since workers' compensation will pay for the medical costs. If you were injured at work, you have a workers comp. claim at the least. If the property was indeed defective, you may have a claim against those responsible for your injury. Please give me a call
