Legal Question in Workers Comp in Pennsylvania

Question concerning repayment of health medical premiums.

My husband was hurt on the job June 19, 2008. He returned on Dec. 2, 2008, after returning & we received his first paycheck our medical premium was double, from $60 a week to $120 a week. Employer states we have to pay back 23 weeks of premium benefits that they paid while he was off work, due to him getting hurt there. We were never informed of this while he was off. Is this how it works when hurt on the job & to have family benefits? Work Comp paid for his work related injuries. Please advise.

I have never heard of COBRA benefits being remunerated retroactively like this. If your Husband is discharged for failing to make the reimbursement, you and your attorney should litigate the outrageous conduct.

Dont be fooled: Workers -even in an enlightened jurisdiction such as the Commonwealth - don't have nearly the rights Fairness would dictate should be due them. You will need to have your lawyer fight for a year or two to get justice - maybe.
