Resigning while receiving WC benefits
In April 2005 I was injuried while at work as a truck driver. I had two surgeries, one in May '05 and the other in October '05, and may require a third surgery in the coming weeks. I was advised not to quit or get fired from my job while my WC case was open. April will be 1 yr since my injury. In that time, life continued and personal circumstances have changed. I don't foresee my knee getting much better and would like to take a less physicallly demanding job. Currently the Dr says I can do sedentary work but my employer has nothing to offer me. My question is this: What obligations do I have to my current employer to return? Do I need to make my intentions known to the insurance company and my employer now? Will resiging from my postion have a negative affect on my case?

You do not have to stay employed with the same employer in order to keep your comp benefits. Contact me if you need more info. Good luck!!
