Legal Question in Immigration Law in Philippines

Hi!

My grandparents have filed a Family Based petition where my father is the principal applicant and we are the derivatives. My question is:

(1) They have retired last 2004, and went back home to the Philippines the next and resides here upto present. They were unable to file an income tax return after that because their retirement benefits does not reach the minimum requirement. Now, the NVC are asking for a copy of the Federal Tax Return. They do not have a copy of that, what will we do? Are they really necessary to submit those?

(2) The NVC have charged the principal applicant for an IVA Fee, are his children/deratives going to pay the same amount in the future?

(3) How can this case be expedited for me (who is turning 21 in June) if our case will be current sometime between the last week of July and the 1st week of August?

Yes, all visa applicants are required to pay visa fees.

Whether it can be processed sooner will depend on how fast you can provide all necessary documentation to the NVC. In your case, I understand that you are facing some obstacles.

A petitioner must be a sponsor, therefore, they must submit the affidavit of support. For that matter, they have to actually reside in the United States (be domiciled in USA). The situation where a petitioner had permanently moved abroad 6 years ago can render him or her ineligible to sponsor the beneficiary. I suggest you discuss this situation with a U.S. immigration lawyer.
