Legal Question in Employment Law in Philippines

my wife's application for maternity benefit has been denied by the sss for the basis of allegedly she had already exceeded the allowable deliveries/miscarriages which is up to first four deliveries/miscarriages only under section 14-a (d) of RA8282 Philippines. As to the history of my wife's pregnancy this is already her fifth pregnancy The first was 1995 (in which she was still unemployed therefore she was not entitled to any sss maternity benefit), the second was 1999 and the last two were both miscarriages 2004 and 2008 respectively. My question is how come they denied her application for maternity benefit since the effectivity of this law (RA8282) was May of 1997 making her claims and deliveries to three only eliminating the actual first delivery (1995)?

If your reported to the SSS that she already exceeded the allowable deliveries then the SSS will surely deny entitlement to your wife. Write a formal letter and explain your situation to the Legal Department of SSS.
