Seperation

I have been living with a man for about seven years and want to get married. Being that my partner does not want to get married I am forced to make the decision of seperation for my sake and my six year old daughter. I do not wish to live inmorally anymore and would like to know my daughter's rights as well as mine. I live in Puerto Rico and I have no family here. I wish to go back to United States and reside with my family but I would like to know if my partner has a right to accuse me of kidnapping or something like that if I do leave with my daughter? I want to be able to part and do things legally right.

You must file a custody suit if the father recognized the child in the Demographic Department Certificate of Birth.
