soon to be seperated

Soon to be sepreated should i file for bankruptcy while goin thru a divorce? Or can I without includin her we have no combined depts.

you can file an individual BK while going through a divorce but you might want to wait if your current debt will influance the amount of spousal support you might have to pay.

It is often best to wait until after the divorce, but it is important to have advice in advance of that decision from competent divorce and bankruptcy attorneys who can work together to achieve the best result, or from a lawyer who knows both areas of the law well. Each case is different, so there can be no generic answer. Do NOT let your spouse know you are considering bankruptcy.
