Felony dui with injury
Last year my friend was coming home from Boston, where he was working. He had a layover in Detroit and a layover in Atlanta. He was anxious to get home, so he rented a car to drive the 120 miles. He said he had a couple of beers in Detroit and a couple in Atlanta. He called me and said there was nobody on the road. he was about 20 miles from home and said he hit a deer, and drove on up to the next lit off ramp. While he was there, 2 sheriff patrols pulled in and said he had left the scene of accident and that he had hit a motorcycle. Not life threatening injuries. He isn't well, either, Pneumonia, gall bladder surgery and he is being treated now for blood clot in his leg. What are the chances that someone arrested for 1st offense felony dui would have to serve time?

Its hard to say at this point. Of all the DUI's that I have handled over the years I have learned to be careful with predictions until I have all the details. If he goes to trial and is found not guilty, then he will serve no time. If he is found guilty or pleads guilty, then there are many factors that a judge will consider in deciding the sentence and whether or not the individual will serve time. Such as, the individual's age, work history, family, criminal record, how much alcohol the driver had, whether the victim contributed to the accident, how badly the victim was injured, the victim's imput of sentencing (some are forgiving and some are not), and the list goes on.
