Adoption

"My question is about the process of adoption related to a husband adopting his wife's child. My husband and I agree that it would be in the best interest of my son if he were adopted by my husband. We don't know anything about the process or where to start. My child's biological father has chosen not to be involved in ANY part of his life from birth. There was never any legal work done to force child support or anything like that. My child is now almost four years old and we hope to get things under way as soon as possible. So if you could help me in anyway to explain the requirements, cost, or any other legal aspects of this matter I would be very greatful. Thank you for your time."

Re: Adoption

It is important for you to seek the advice of local legal counsel as different states have different requirements. However, if the father refuses to give consent you might have to bring an action to terminate his rights as a parent. You have adequate grounds for that action as he has not seen the child or paid support. The father must be given notice of any adoption proceeding and obtaining his consent to the adoption will facilitate the ease of the adoption. If the father can not be located then your local legal counsel will explain the procedures to you.
