In South Carolina if a child is born out of wedlock the mother has sole custody of the child. The father does not have any rights of custody or visitation unless he has been given those rights by the Family Court. If father is not paying child support I would suggest seeking child support through the SC Dept. of Social Services, because you will be able to get child support without father getting a visitation order. If you seek child support through the family court father may seek visitation in the same action. If you and father are married, you both have equal rights to the child.
