Legal Question in Family Law in South Carolina

My daughter is 5 years old. At the time of her birth her biological father was mia. My boyfriend at the time took care of her and almost a year later signed her birth certificate and she now has his last name. on her birth certificate and social security card. When the DSS go after child support is her biological father responsible for paying or will it be the father thats listed on the birth certificate even though I know the guy who signed her birth certificate is absolutely not the biological father?

If you have told DSS the name of your daughter's biological father then they will seek child support from him. He has the right to request a paternity test after he is served with papers for child support. The paternity test will show whether he is the father. Once he either admits he is the father or has a paternity test showing he is the father then he will be responsible for child support. If DSS is questioning you about the name of the man on the child's birth certificate just make sure you explain why he is named. If they do try to get child support from the man on the birth certificate he needs to ask for a paternity test so that he will be excluded.
