Legal Question in Family Law in South Carolina

My husband is trying to obtain his birth certificate. When doing so, he was told that the last name that hes been going by for the past 20 years isnt the correct last name that there is a different last name on the the birth certificate along with a different father that is not his biological father. His mother will no provide us with this information and legal aid in our state will not help. What can we do to get about getting his birth certificate?

You can request a copy of his birth certificate online at www.scdhec.gov if he was born in SC. If he was born in another state just do a search for that state's vital records and you will likely find a site to request a birth certificate. If your husband wants to correct his name on his birth certificate he could file an action for a legal name change to change his birth certificate to the name he has been using for the last 20 years. Along with the petition he will need a SLED background check and a statement from DSS that says he hasn't been listed with DSS for abuse or neglect.
