can a mother and her new husband adopt a child from a previousl marriage without the father's consent?

A consent is generally required for the adoption of a child from a previous marriage. You can ask the court to terminate the father's rights under certain circumstances. He will have to be named as a defendant and you will need to serve him a summons and complaint. He will have an opportunity to challenge the adoption.
