Legal Question in Family Law in South Carolina

My son is 1 year old. His father is illegal in the US and he is threatning to take my baby away and take him to Mexico regaurdless of what i say. His name is not on the Birth Cartificate or on nothing. What rights does he have. If we go to court can he get visitation.

He does have certain rights as the child's father, but the best solution for you is to file an action with the Family Court to address custody, support, and visitation. If he is illegal, then you can point that out and possibly notify INS to have him deported.
