Legal Question in Civil Litigation in South Carolina

slander/defram ation of character

In 1999 i engaged in a extra marital affair, however this was not a factor when i divorced in 2004. My former best friend had a box of my personal momentos to include letters, photos, cards and other letters and when i requested the items she mentioned she destroyed the box in 2005, now i have found out that she actually gave to my former husband whom she befriended to include his wife. The wife is now divulging the contents of the box to my former inlaws and i need to know what are my options. My biggest fear is that they will show my son and i am truly concerned, the new spouse is now divulving to others. What recourse do i have against my former friend and spouse to insure that my son will not be exposed to the contents. former husband in FL and former frined in NC

Re: slander/defram ation of character

If the information she is spreading is true, you will not have a slander or defamation claim. If the contents are items you gave or sent to her, there is probably little you can do to prevent her from sharing them with others. If there are items that could be considered your property, you might be able to insist that she return them to you. You shouldto consult a family law attorney regarding the issue with your son.
