Legal Question in Civil Litigation in South Carolina
Small claim case
I am in the military and need to file a small claims case against someone. I left this person to take care of my house while I was overseas. They stole a credit card, money, and vandalized my house. But I am about to be changed to another duty stations in about a month. The court said that it is going to take longer than that to file my case and get it before a judge. What can I do to get this done as soon as possible? Can I request a court date? A date that I know that I can take leave and be back in town to go to court? I am running out of options.

I'm afraid that only the court can answer those questions. You can however have a lawyer handle the case until you get back. The law provides certain protection for military personell. Its possible to have it filed and then put on hold until your available. The other thing I would mention is that what you have described is a crime. I am wondering why you have not sworn out a warrant for the persons arrest. If he/she were convicted they would be ordered to pay you resitution for your losses. Good luck.
