Legal Question in Civil Litigation in South Carolina
Small Claims/Magistrate's Office
I have filed a small claims complaint against a former finace. I moved in with him in his SC rental home. He became aggressive/controlling, so I ended the engagement and moved out. He changed the locks, so I couldn't retireve my personal belongings. He then claimed I was his tenant and owed him rent. He added storage fees for my personal belongings locked in his bedroom. (I never signed any documents.)
A court date has been set. He has now decided to release my belongings. If all goes well, can I have the claim/complaint dismissed after I retrieve my items? (He still says I owe him money which he is ''allowing'' to slide; however, the Magistrate is his friend and agreed that I would have to pay him rent if we go to court....?) True?

Re: Small Claims/Magistrate's Office
Whether you owe him rent is up to the magistrate, but it would be unlikely unless you agreed to it somehow before or when you were living there. As far as getting the case dismissed, that is up to the magistrate/court, but would be improper in Georgia.
