Legal Question in Personal Injury in South Carolina
automobile accident
if a person is not released from the doctor can a lawyer begin to settle their case anyway?

Re: automobile accident
Generally, attorneys will wait until the client has completed all medical treatment to minimized the chances that there will be any future, unexpected medical problems. Of course, that is in the client's best interest.
However, in cases where the client will be treating for long periods of time and/or where the client may need additional treatment in the future, the attorney can factor in such "future" treatment and settle the case.
This method is not as safe for the client, as the anticipated costs in the future could be much higher than estimated, but sometimes it is necessary to take this approach.
