Legal Question in Personal Injury in South Carolina

Reasonable Amount for pain and suffering

My 24 year old son was rear ended while driving his 87 Toyota pick up truck in South Carolina. The other party was cited and now insurance company wants to settle for $800 pain & suffering. He has injured his back, has muscle spasms and has been put on 'light duty' for 2+weeks at work. His vehicle was totalled & he has had to purchase a new one, total unexpected. He has been significantly inconvenienced as have we in getting all this worked out. Is $800 a reasonable amount to settle for? If not, what would be the range you might expect? His medical expenses thus far are about $1200.

Based on the limited information you provided, that offer certainly sounds very low. However, there are many factors which much be considered when evaluating a settlement offer in any given case.

The insurance company's goal is to settle the case for as little as possible, and their adjusters are experienced in working toward that end, as they do it on a daily basis. For that reason, it is important that your son have an experienced advocate for him as well.
