Legal Question in Personal Injury in South Carolina

settlement

I was wondering how the settlement process works. my attorney is telling me that the check that is made out to him and i gets deposited into his account and then he writes me a check for my cut. i would think that it is the other way around. i get the check and then i pay him his fee? i need some insight. thanks.

The settlement check is generally written payable to the attorney and the client jointly. The funds are typically deposited into the attorney's trust account, and once the funds are actually in the account (about a week later), the attorney disburses the funds to (a) medical providers for any liens, (b) client for his/her portion, and (c) attorney for his fees/costs.
