Legal Question in Civil Litigation in South Dakota

Enticement

I am being sued by a woman for "enticing" her husband away from her.The complaint reads that I undertook a course of conduct intended to entice the affections away from her. She claims that my acts were the proximate cause of the loss of the affection and consortium of her husband and she has been damaged by my actions and is seeking damages. I have 30 days to respond. Do I hire a lawyer and fight this and could I countersue for damages she has inflicted on me herself? A nasty divorce is in the works now and she is out to get everything from both of us.

Re: Enticement

The old cause of action of "alienation of affections" has had a comeback in South Dakota. You definitely need to contact an attorney regarding your response to the complaint, your defenses, and any counterclaims you may have. Do not ignore the time to respond to the complaint! I would be happy to discuss your case with you. You can contact me at [email protected] or 605-332-5999. You can also consult the State Bar of South Dakota's Lawyer Referral Guide for a South Dakota licensed attorney in your immediate area. That number is 800-952-2333. Good luck!
