Legal Question in Civil Litigation in South Dakota

verbal agreement

Is a verball agreement leagal in sc when someone told you if you would find him an attorney and walk him all the way thru the process until it was settled, thinking he wouldn't get anything and if he did he would give you half after all fees. His wife, which is my wifes mother heard the whole thing and thinks I should keep[half the money. He has already put it in my wifes name in a cd and he is getting the interest off it. Now he wants to take it out of her name so he can give some to his daughter which he has already given her 50,000. The total settlement was 600,000 and his wife recieved 141,000 for her half but he made her sign her check and put it into his account. I want to keep the money so when he passes away I can give my wifes mother her money she should have already received.

Re: verbal agreement

I was thinking about it after you and I talked on the phone. You might want to consider doing something immediately while everyone who would be involved is in good enough health to maybe accomplish something. Since legal matters take so long in the court system you wouldn't want to wait too long. Its amazing how often people will change their minds once they get notice of where they stand on an Attorney's letterhead. One other possible consideration is the Statute of Limitations which we didn't discuss. Again, you are welcome to call or write to [email protected]

Re: verbal agreement

I am sorry and no offense, but your question is really hard to understand. The best I can figure is that you found someone an attorney in exchange for an agrement that you would be paid half. But then it gets really confusing when your start talking about the guy's wife, and giving money to a daughter and the wife received a share and then you wanting money when he passes. No competent lawyer will give legal advise without being sure that they properly understand the fact. I am working in the office tonight and this weekend and if you would like to call I can ask a few questions to clarify a few things and then tell you what you need to know. This site will not allow me to type in my office number in this answer. But if you go back and click on my name you will see a phone number. Robert Johnston
