Legal Question in Bankruptcy in Tennessee

Personal corp. debt responsibility

I have been contacted by a debt buyer/collection agency demanding repayment of a corp. credit card debt that was included in the failure and bankruptcy of my company in 2004. I have no records of this and do not remember any personal responsibility. The collection company says this debt is not covered by the FDCPA so I have no choice but to pay. Is this correct?

It depends on your bankruptcy filing. If this debt was part of your bankruptcy, then the application of the FDCPA is not relevant as bankruptcy law will apply. A discharged debt (the only thing you get out of a bankruptcy) means that creditors cannot collect on it.

Depending on the amount of the debt, you may want to consult with an attorney to help you handle this situation.
