a friend of mine got busted with 450 80mg oxycontin pills legally obtained from a doctor and drugstore. they were selling these drugs. whats the penalty in tn for selling oxycontin 80mg.

�OxyContin� is a trade name for the drug oxycodone hydrochloride which is a Schedule II Controlled Substance. In Tennessee, the crime of sale, possession for sale, or delivery of a Schedule II Controlled Substance is governed by TCA 39-17-407. The ultimate penalty that could be received is dependant on the a number of factors including the amount of the controlled substance, the defendant�s criminal history, and whether the defendant is charged in a State or Federal court.

Generally, In Tennessee the sale, possession for sale, or delivery of a Schedule II Controlled Substance is a Class C-Felony for which the potential jail time is 3 to 15 years. In addition, if the offense took place in a �School Zone� the potential exposure could be from 8 to 30 years or more with mandatory jail time at 100%.
