Legal Question in Criminal Law in Tennessee
My husband was released by a judge in Robertson county TN. Rutherford county TN has a hold on him for violating probation How long does Robertson county have to pick him up?
1 Answer from Attorneys
There is no fixed deadline in the statutes. Courts use a standard of "reasonable time." For two counties side by side, it's usually three working days. From one side of the state to the other, it might be two weeks.
After all, at least one and maybe two deputies may have to drive a long distance, stay overnight, then make a long drive back with the inmate. That takes time to plan and schedule.
The most important thing you can do to help your husband is make sure the Robertson County Jail promptly contacts Rutherford County and alerts them to the fact that your husband is ready for pickup.
By the way, it is the duty of the requesting county to come and get the inmate, not the duty of the holding county to transport him.
Also, any time spent residing in Robertson County solely while awaiting transport from Rutherford County should be credited as service of confinement
(prehearing or pretrial confinement) if any sentence is later ordered in Rutherford County.
