In a race discrimination lawsuit, what does it mean to be ''similarly situated''? If the jobs are the same but the job titles are different and the salaries are slighty different, are the employees ''similarly situated''?

Not necessarily. A court will look to a number of factors to determine if employees are similarly situated. Among the factors are the positions occupied, the time frame of the conduct, the type of conduct, the relevant supervisors and the applicable policy. There is a body of caselaw devoted to the development of this area of the law because of its importance to many cases seeking to prove discrimination.
