Recording Songs Written By Others

My daughter is a singer who is going to record an album in Nashville. We have bought the rights for her to record songs written by others, with free recording time included. Most of the songs were co-written by the man who will produce the album, so I don't see a problem there. My concern is that one of the songs was written by a ''famous'' performer. Should I ask to see a written release by this performer for someone else to perform this song? I do not want my daughter to include this song on her album, sell the album, and then be sued by the performer. Thank you for any help you can give us on this matter.

Yes you should ask to see the release. You should also have all contracts you or your daughter are asked to sign reviewed by an attorney. Such a review should not cost you very much and could save you from unintentionally agreeing to terms which cause you a loss down the road. These types of arrangements can be very beneficial for both the performer and the producers if handled correctly. Unfortunately there are some unscrupleous folks out there who take advantage of new inexperienced performers. Good luck and I hope to hear you daughter on the radio soon!
