my new husband wants to adopt my minor child from a prior relationship, but the biological father dies before legitimizing his parentage...what are our options?

You will want to proceed with an adoption by a step-parent. The issue with the biological father can be addressed in the adoption petition but with the information you provided, it does not look like it would be a problem with proceeding forward with the case.
