Legal Question in Family Law in Tennessee

interstate divorce law

I am currently a resident of Tennessee. I was married in Connecticut 6/01, and moved here 3 days later. My husband moved to Tennesse, although never living with me, and then left to go back to Connecticut in December of 02. I received divorce papers filed in Connecticut by him. Is it possible to have the case transfered to Tennessee since my property is here, I have a delbilitating/life threatening illness, and four children I need to take care of. The trips to Connecticut would also be a financial burden I could not handle. Thank you for your advice on this matter.

The only way that you will get jurisidiction here is for your husband to dismiss in CT and you file here. There is a question of how much subject matter jurisidiction the Court has over the property here. Case law in TN has not really successfully addressed the issue of property division when there are two states of domicile. But it wouldn't appear that there can be too many areas of contest in this matter. You really need to consult directly with an attorney for a complete review of the facts and circumstances.
