Living in Different State after divorce

My mother got a divorce in Ky. She now lives in Tennessee and has for over a year now. Can she use a lawyer from here to help fight to keep her exhusband from taking her children from her. He is trying to take my two youngest sisters from her. She is a very good mother. Also does it matter that she swings as long as nothing ever gose on infront of the children or no one ever comes home with her or my step dad. Like I said she has always worked hard and took care of the three of us and do without for us to have. She leaves my middle sister once in awhile to watch my youngest sister once a month so that her and my step dad can one night out and once they stayed out all night. Can any of this be used against them.

Not sure where the "here" is that you ask if you mother could use a lawyer from. If she has and the child have lived in Tennessee for more than the last six months, then jurisdiction on the case should be in Tennessee. Under TN law, what she does in private when the children are not with her, and which she does not even tell the children about or expose them to, should not be allowed to influence the outcome of the case.... but that does not mean a judge would ignore it. This might be a case that your mother would need to be prepared to appeal if she loses at trial. But if your mother is concerned she may end up in a custody case she should now be doing a number of things to position herself to improve her chances of winning. It would also be a good idea for her to consult directly with a Tennessee attorney prior to any case being filed, just to make sure she ends up in the best position to win.
