Separation agreement

My wife and I have agreed, in case we divorce I,the father will keep my child. How do I make this legally binding?

Under Tennessee law, there is no way you could make this agreement "legally binding".... but you could still get it reduced to writing and have the written agreement set out all of the reasons you both agree the kids would be better off with you.

While she can later change her mind and argue it all in court, the agreement to the REASONS would still be admissable into eveidence and could be a very powerful factor in the court's decision. The important thing is to get the agreement worded with clear cut statements as to why they children would be better off with you.
