Legal Question in Family Law in Tennessee
Social Security Records
My wife received temporary custody of her great-neice. We are trying to get her in a local school but, the school system requires the mother's social security number. Even though the mother signed the paper giving us temporary custody, she refuses to give her social security number. Is there something we can do? We can't even get her in school.

Tennessee law requires that any custody entry, agreed or litigated, carries the information of the natural parents, as well as the custodial and residential information. Therefore, if this has been done through the Courts, the attorneys representing the parties must provide such information.
If the custody transfer was done solely through an informal means, then it should be reduced to writing and formalized through the juvenile court.
Any failure of a parent to abide by a Court ruling is contempt, and a motion for such a finding can be made.
The law requires that any custodial person of a child under 18 has an affirmative duty to provide that child with schooling. Failure to do so can result in criminal sanctions, up to and including jail time. So whatever you have to do, you want to it quickly, because as of this point in time, your wife has the liability to see that child gets into school.

If the change of custody is a Juvenile Court order, that should clear you putting the child in school. If there is no order, take your documentation to the local Juvenile Court and ask for a temporary custody order.
