Legal Question in Family Law in Tennessee

Can I be unknowingly divorced?

My husband and I married in 1988, and we have two children together. We have been separated (not legally) since 1992. My children and I resided in California up until 2 years ago when I had to send my children to Tennessee to stay with their father. I am still in California. In a letter, my husband informed me that he had remarried. The stepmother claims that my husband told her that he had gotten a divorce from me, and I just was not aware of that fact. Is this possible? If so, how do I go about obtaining proof of this occurance, whether it be in California and/or Tennessee?

Via publication, this is possible, but doubtful. Generally, if he knew where you live, he should have served you with paperwork for starting a divorce. If you know the county of divorce, call the court to get a copy of any decree. For more info, see www.gsmithlawfirm.com
