Legal Question in Medical Leave in Tennessee

denied flma

I have worked for this company for over 24 years.I have COPD,dibetes and had a triple by pass this March the 17th and stayed out for 7 weeks and went back to work.In july of this year my lung collaged and I was out for 4 more weeks.With a 5 days here and there I used my 12 weeks up in August of this year.My Flma was up to renew it in September and I was told I was Denied,that I had to work another 1250 hours before I could take Flma again.I feel ok but with my illness I'm scare if I had another heart attack I will lose my job.With 12 weeks off from 2005 to september 2006 and 5 weeks for vacation I still worked more than 1250 hours in this time frame.I don't understand how they can do this.I thought I was entitle 12 weeks in a 12 months period.Like I said I feel great right but what can I do if I have a serious problem again.My company goes from the time you fill out your Flma.My was up in September and I waited to renew it in November and I was Denied.My Doctor filled out the Flma papers.The illness that I have I will always have.

You may be entitled to FMLA leave. Once you have worked more than 1250 hours in a year and have more than 1 year of service (both of which I understand you to have met), then you are qualified to take FMLA leave. If your employer is denying you leave, you probably need to contact an attorney to help you resolve this issue with your employer.
