Legal Question in Medical Leave in Tennessee

famil medical leave for panic/anxiety attacks

does having recurrent panic attack or anixety attacks allow me to take this? i have them every day to every 2 to 3 days. i've had to call into work 2 to 3 times a week. medicene that my doctor has perscribed is not working, except my xanax, which knocks me out, especially when i have a panic attack. am i eligible for this? my doctor is sending me to a psycologist for med. control, but he can't see me for another month. my current doctor has put me out of work for a a month and i don't know how long it's going to take to get these under control.

It depends on whether the condition qualifies as a "serious health condition." Generally, a serious health condition requires a period of incapacity. For more information about what is included in the definition of a serious health condition, visit this website, http://www.dol.gov/dol/allcfr/ESA/Title_29/Part_825/29CFR825.114.htm

Of course, you must be eligible (more than 1 year of employment and 1250 hours worked in preceding 12 months) and your employer must be covered (50 or more employees within a 75 mile radius).
