Legal Question in Immigration Law in Tennessee

I married my husband who is here on J1 Visa with a two year homestay requirement, when his scholarship ends on July 31st. We spoke to an attorney, Timothy Coode, who said we have a case for a hardship waiver. I have so many health problems. I was just diagnosed with Major Depression, I have advanced Endometriosis that I need a surgery for but can't afford because I had to quit my job due to my health problems. I also have Pseudotumor Cerebri, which is excessive Cerebral Spinal fluid on the brain and spine, and has caused me to already lose some of my vision, and have to take high doses of medication for everyday or I could go blind. They do not treat these health problems in his home country of Egypt. We have all the papers to fill out for the waiver, all my health records, we basically need someone who can help us fill out the forms properly. We have saved up money, and we are so broke because all the money we get we have to save for this waiver. If you could help us, please let me know. Thank you so much for your time.

What your husband is doing in USA on J1 visa (what program he is enrolled into; who sponsoder his program, etc)? Why he nees specifically a "hardship" waiver? There are some other ways to apply and obtain a waiver of the 2-year foreign residence requirement where no showing of hardship is required.

The waiver government filing fee is only $215. This is a really not that significant fee, compare to other immigration forms and applications. Legal attorney fees could be as less as $1,000 - $1,500. Any knowledgeable attorney can represent you in this application, not necessary one located in your city and State.

Only when you get a favorable recommendation from the US Department of State on his request to waiver 212(e), can he apply for adjustment of status (green card).

Usually, if properly submitted, a waiver request takes only few months.
