referral fees
what determines when a person is an employee vs paying referral fee's or other type of compensation. I am starting a commercial brokerage firm and want to pay for referrals but not hire as an emloyee.

Generally, the question of whether someone is an employee or not relates to the degree of control you exercise over the work that individual does. There are other factors to be considered such as, where the work is done, restraints on the individual doing other types of work and who supplies the supplies necessary to do the work.
