Legal Question in Personal Injury in Tennessee
accident
July of 2006 my husband and I were
hit broad side at a 4 way stop by a vehicle that ran a stop sign. But, the stop sign was missing. The truck was totaled and I went to the emergency room in an ambulance with a severe concussion. Even though a police report was filed, our insurance company can't locate the other party and record of his having insurance was never substantiated. Our insurance company totaled out the truck, but we never made any monetary settlement for bills or anything. My question is, who can we go after
for this accident? the city because the sign was gone? The guy who hit us? (We already talked to the police department and they will not go after him because his insurance was bogus.) Our insurance company? The guy that hit us was
from Memphis and has seemingly
disappeared from the face of the
earth. If you can give me clearity
or direction, it would be appreciated.

Cetainly you ahve a cause of action against the person who hit you. An action against the city would be hard to prosecute unless the sign was gone for along period of time. If you have uninsured motorist coverage, you may be able to add your insurance company as a defendant. Hard case with the missing sign though.
