Legal Question in Personal Injury in Tennessee

the law on having a lawyer i'm not happy with

i was in an auto accident 2 years ago and hired a lawyer and i feel he is not doing what is best in my interest. i want to know if i can not use him and find another lawyer for my case? he has filed a law suit..i am still having problems from the accident..

You have the right to hire or fire any lawyer you want. However, it is my experience that when you discuss your situation with a new lawyer, you will learn that your present lawyer is doing a fine job. In any event if after giving it careful consideration, you do not think you are being represented the way you wish, then you may hire substitute counsel or co-counsel. If you terminate the services of you lawyer, he or she may have an attorney's lien and will be able to recover a reasonable amount for the services rendered from any recovery you may receive. You are also responsible for the expenses he/she has incurred on your behalf. Therefore I suggest you discuss your concerns with your current lawyer first and see if you can accomplish your goal that way. Good Luck.

My first bit of advice is to try to work this out with your lawyer. Lawsuits are not fast. Sometimes they just take time. It may be that the lawyer is doing more than you realize. Give him the opportunity to explain the situation to you and prove to you that he is worthy of your trust. Don't shoot the messenger, just because he tells you something you don't want to hear, don't abandon him. You want someone who will shoot straight with you. Give you the bad as well as the good. The bad will not go away just because he does not tell you.

If you cannot resolve this with your lawyer, you can always terminate his services and go hire another attorney. Do this in writing and take a copy of the termination letter to interview other attorneys. You old attorney will be entitled to receive compensation for the work he has already done. Good luck.
