Legal Question in Technology Law in Texas

data ownership

I purchased an accounting software from the software manufacturer. Data was entered into the software via their front-end application and stored in Microsoft SQL Server database. Question 1. Who is the owner of the data that resides in the SQL database? Question 2. If I hire a third party vendor to add or manipulate the data in the SQL database, can the software manufacturer void my service contract?

Re: data ownership

First and foremost, get a copy of the EULA (End User Licence Agreement) that you may have agreed to when you purchased or used the software.

The data should be yours. There should not be nothing special about storing data in a Microsoft SQL Server database. Sounds like you bought it because of the front end application.

As for manipulating the data, turn to your EULA. Sounds like a vague answer but a good EULA will cover most contingencies. Also, if your data is saved in a format that let's say another application can import and edit it you may look into it. However, find the EULA or call the company and ask for a copy. If need be speak with their legal dept.
