Legal Question in Construction Law in Texas

I used to work for a construction company until August of 2006 that had different subsidies in the rebar and concrete division. The Vice President of the concrete division felt bad that I was not receiving a paycheck for the work that I had been doing on his company, so he offered to have the concrete division conduct work on my patio in my backyard. The job was never completed and it has been over a year. But since then, the Vice President is in the processing of resigning. This month the President of the company is now sending me a bill $12k. I contacted the Vice President and he informed me that he will sign an affidavit stating that the work was to be done at no cost to me. Will this hold up if a lien is ever filed on my house?

It should as long as the VP was acting within the scope of his authority, and it looks like it to me.

Since you never signed a contract, a lien will not attach to your property. If they file a lien affidavit, they've put cloud upon your title, and that's actionable.

The affidavit should hold up if there's a lawsuit. Just make sure the affidavit is proper, and there an attorney can help.
