Legal Question in Consumer Law in Texas
lawyer commits fraud; firm won't admit
two years ago they disc mold in our home and Farmers told us to vacate We went to Spagnoletti & co We first met with Ed Poole Rather than paying off our mortgage from the next Farmer's check, he recmd a const co called Industrial Air Quality Mgmt, or IAQM IAQM sent a bogus Clearance Test to the Mort co who then sent 28,000.00 to IAQM We went back to Spag armed with written proof that Ed Poole is a co-owner of IAQM! Spag first asked us where we got our doc from, then said that Ed Poole is no longer with the firm. Spag has filed against Farmers and Ashton, but not IAQM. It was only after we produced the smoking gun from Nevada that Spag agreed to a 8500.00 advance to get us out of forecls We could ask Spag for another advance? I say we should get all of our advance winnings!Or, we could file for bankruptcy to protect our mortg We only owe 50,000 on our home and it is our only investmt If we get the 28,000 back from IAQM, we could rebuild our home! Should we just let our home go back to the mortg co after all we've been through? How do we go after Ed Poole and IAQM, since Spag is not?

To answer your question. I need to know whether you settled your claim with Farmers or it is still pending. That is, did you accept any money from Farmer and sign a release?
As you know, Ed Poole works with Famers a lot and is involved with their mold litigation very frequently. I cannot say whether you can sue Ed Poole. Probably you cannot, since you did not hire him to inspect and test the mold on your property; Farmers did.
I don't understand your question regarding the lawyer and fraud. Please explain?
