Legal Question in Consumer Law in Texas

motor home purchase

It has been less than 30 days since purchased 174,000 motor home. Several significant items were not working from beginning (unaware). Can it be returned just as anything else, or are we stuck with it. Is the dealership liable to give us a loner of comparable value to use while ours is being serviced?

i doubt if the dealerships return policy equals Wal-Mart's. You signed a contract to pay for the vehicle. Is it financed or did you pay cash? Are the defects being fixed? The dealer has no legal obligation to give you any kind of loaner unless there is some provision in the contract. Was this a new one or a used one?

You are under contract to buy that motor home. Unless you bought it used, without warranty, the dealer is obliged to fix it. If you bought a new motor home, it may come under the Lemon Law. Take a look at the Lemon Law information on our website at http://www.bradie-law.com.

The dealer is under no obligation to give you a 'loaner' unless they've publicly state that they give loaners, or it's written into your contract.
