Legal Question in Consumer Law in Texas
Puppy purchased died in 24 hours, no refund
We gave a lady a deposit for a puppy on a Wed, and on Fri we met at a parking lot to exchange the puppy & final payment. We wanted to meet at her place but she said we couldn't, we would have to meet where she wanted. She said puppy had shot's the day before and might act sleepy. Sat the puppy slept all day & was very weak. Sun I called ALL day, & no answer. At 9:30 pm I left a message the dog was VERY sick. Mon morn, I talked with her, I didn't think the dog would live. She said she couldn't do anything today (Mon) but Tues she would pick it up. The puppy died Mon night. Tues morn I called a vet & explained everything, he said it sounded like Parvo. She never called back & we have never talked with her again. Wed, I spoke to her daughter who said she would try to get another puppy, but never heard back from her. Fri I spoke to a man at her home, he said she was not talking to us again, not replacing puppy, or refunding money. She did mail a bill of sale. It wasn't signed and a note said she was sorry. What can we do? We are in Texas. This was a registered puppy and were are out several hundered dollars, all we really want is a puppy of the same breed!

Small claims court is your recourse for claims under $5,000.00.
