Legal Question in Consumer Law in Texas

Purchase Orders as Contracts

A customer places a blanket purchase order for five different ship dates and lists the cost of the product because it's a special price. The manufacturer ships the first container and then tells the customer that they can't honor the sales price for the remainder of the order. The order can be shipped, just not at the sales price.

Is this legal? I thought a purchase order was sort of like a binding contract.

Thank You!

Re: Purchase Orders as Contracts

If there's nothing else, in writing or otherwise, then the seller has breached their contract of sale and the buyer has certain remedies available to them.

We handle a lot of commercial cases. Let me know if you'd like to pursue the matter.
