Legal Question in Credit and Debt Law in Texas

I am being taken to court for a credit card that was written-off as a bad debt in 2008. I assume the debt was bought by a debt collector (who is the party that is taking me to court). The papers indicated they want to place a judgement against me. I am not in a financial position to pay the debt. What can I do? What can I say?

Inability to pay a debt is not a defense to a lawsuit based on the debt.

You want to make them prove their case. You can do this through pre-trial discovery.
